As a follow-up to these measures, investigation was conducted by the Prosecutor General’s Office based on numerous reports in the local and foreign mass media about the crimes committed by the French citizen Gilbert Minasyan, a member of the ASALA terrorist organization, who has been repeatedly convicted of terrorist activities, and by a group of 15 experienced militants led by him.
The investigation established that French citizen Gilbert Minasyan and a group of 15 experienced militants led by him entering into criminal relations with persons in Armenia and the occupied territories of the Republic of Azerbaijan and uniting as a criminal group, in violation of the provisions envisaged by the Law of the Republic of Azerbaijan “On the State Border” and the Migration Code, illegally crossed the internationally recognized (in accordance with UN Security Council resolutions No. 822 of April 30, 1993, No. 853 of July 29, 1993, No. 874 of October 14, 1993 and No. 884 of November 12, 1993) state borders of Azerbaijan without valid travel documents and outside the checkpoints, i.e. through the territory of Armenia. There are well-founded suspicions that they visited the city of Khankendi and other occupied settlements, and to support the illegal so-called regime of "Nagorno-Karabakh Republic" they are used as mercenaries by the political-military regime of the Republic of Armenia in the aggressive war against civilians and the armed forces of the Republic of Azerbaijan carrying out anti-terrorist operations, and aiming at the occupation of the territories of the Republic of Azerbaijan.
The investigation also revealed grounds for suspicion that the above-mentioned persons participated in terrorist activities against the citizens of the Republic of Azerbaijan using illegally obtained firearms, ammunition and spare parts.
In addition, when the hostile armed forced retreated, evidence gathered by the prosecution authorities in the liberated territories confirmed that the foreign mercenaries had used the illegally imported weapons against the Azerbaijani army.
With regard to the above-mentioned facts, criminal proceeding was instituted by Prosecutor General of the Republic of Azerbaijan under Article 100.2 (conducting aggressive war), Article 120.2.1 (deliberate murder committed by criminal community (organization)), Article 120.2.4 (deliberate murder committed with special cruelty or in publicly dangers way), Article120.2.12 (deliberate murder on motive of national, racial, religious hatred or enmity), 214.2.3 (terrorism), Article 279.3 (creation of armed formations or groups, which are not provided by the law), and other articles of the Criminal Code of the Republic of Azerbaijan. The investigation was entrusted to the Investigation Department of the Prosecutor General's Office.
Mutual legal assistance requests were submitted to relevant authorities of countries of their citizenship.
Intensive investigation measures are underway.
As previously reported, the criminal case against Arthur Ohanisyan, a citizen of the French Republic, and Vahagn Chakhalyan, a citizen of Georgia, who committed similar crimes, is under investigation.
The Prosecutor General's Office of the Republic of Azerbaijan states that "any law" adopted by the so-called regime in our occupied territories to legalize the use of mercenaries and terrorists does not exempt from criminal liability those who commit such acts in violation of international law.
