Azerbaijan set to stiffen penalties for illegal gatherings, demonstrations, rallies
Azerbaijan is set to change the name and provisions of the article that prescribes responsibility for illegal gatherings, demonstrations and rallies, and toughen penalties for such acts, AzVision.az reports citing APA.
The parliament that this article has emerged in a new edition in the Code of Administrative Offences.

In the new Code, Article 512 titled “Violation of the organizing and holding of gatherings” says “for the violation of the rules of the organizing and holding of gatherings, demonstrations, rallies, street processions and pickets, prescribed by the law ‘On freedom of assembly,’ individuals are to be fined AZN 1,500 to 3,000 or sentenced to public work for 200 to 240 hours or administrative arrest for two months in consideration of the organizer’s personality. Other officials are to be fined AZN 3,000 to 6,000 and legal entities AZN 15,000 to 60,000”.

“For the violation of the rule prescribed by the law “On freedom of assembly,” individuals are to be fined AZN 1,500 to 3,000 or sentenced to public work for 200 to 240 hours or administrative arrest for up to two months in consideration of the organizer’s personality.

According to the second item of the Article, for the participation in gatherings, demonstrations, rallies, street processions and pickets held in contrary to the law ‘On freedom of assembly, individuals are to be fined AZN 300 to 600 or sentenced to public work for 160 to 240 hours or administrative arrest for up to two months in consideration of the organizer’s personality.

According to “Note” of the Article, in case of the presence of signs of the criminal elements in the above-mentioned acts, individuals are to be brought to criminal responsibility under the relevant articles of the Criminal Code.

The current Article #298 is called “Violation of the rules of organizing and holding gatherings, demonstrations, street processions or pickets” and shortly specified as follows: “Individuals are to be warned or fined AZN 1 to 13 for violation of rules prescribed by law for organizing and holding gatherings, demonstrations, street processions or pickets”.

The new Code on Administrative Offences submitted by the Azerbaijani president will be tabled at the parliament’s upcoming plenary session. If approved, the Code will come into force on January 1.
