According to law on Central Bank, the Central Bank is a state body. In this case, which branches of power does it belong to: legislative, executive or judicial? Maybe is it a revolution in the theory of state and invention of a new branch of power? The constitution of Azerbaijan has not determined which branch of power the Central Bank of Azerbaijan belongs to. Because, it’s not a state body. For example, Central Bank of Russia is a legal entity. If Central Bank of Azerbaijan is a state body, then duties of its employees must also be included in the classification of civil servants. However, this classification does not include such duties. If Central Bank of Azerbaijan is a state body, can the state body give a credit or get interest on credits? No. So, the Central Bank of Azerbaijan is not a state body. The state body which does not implement state power denies itself”, he stressed.

Shahin Aliyev said according to the statue of the 44 state bodies, either they are central executive power or their status is equal to the central executive power: “According to the constitution, heads of these bodies are members of the government. The functions of government members are carried out by the heads of central executive powers and these functions are in the narrow frame.

These are ministers, chairmen of committees and heads of several services. If we look at others’ functions, we’ll see that their status is equal to the central executive power’s status – for example, State Procurement Agency. These bodies engaged in organization of procurements and tenders. You may ask: What executive power’s functions does this body implement? Actually, such bodies must be public legal entity. It has no executive functions. Except the Cabinet of Ministers, there are only two executive bodies in the management – central and local”.
