According to The Times News of Kingsport, on July 9, at 3 a.m., Church Hill police came to the motel after a disturbance complaint and were advised that a woman had been thrown from the second floor balcony to the ground. The police found that the woman was lying in bed crying and the two men smelled of alcohol. The woman did not have life-threatening injuries but was taken to Holston Valley Medical Center for observation.
Church Hill Police Department Officer Ethan Mays stated in his report, "I was furthered advised that they dragged the female back into their room, room 209. Upon my arrival, I went to room 209 where Sgt. Mike Allen of the HCSO had arrived and began knocking on the door. After knocking several times, the door opened and a male identified as Wesley Marshall emerged advising that he had just woke[n] up."
According to a witness, the young woman consented to have sex with the other man, and when Marshall asked her to have sex with him, she refused. Allegedly, he became angry and threw her off the balcony. Then, the two went to the first floor to retrieve her.
Moreover, Marshall reportedly threatened the second man, saying, "I don`t know you that good Kris, but I swear to God if you put me in this I`ll get you." Besides being sentenced to 10 days in jail, Marshall is to serve 11 months and 29 days of probation, as well as 96 hours of community service. After having served 75 percent of the sentence, Marshall will be eligible for early release.
