Judge refuses to stop flow of oil through Dakota Access Pipeline during appeal
US District Judge James Boasberg has denied a request by the Standing Rock and Cheyenne River Sioux tribes to prevent oil from flowing through the controversial Dakota Access Pipeline while the tribes appeal his March 7 ruling to allow construction of the project to be completed.
"The critical factor here is Cheyenne River's lack of likelihood of success on the merits ... plaintiff does not have a strong case on appeal," Boasberg said in his ruling Tuesday.
