Azerbaijani Ombudsperson Elmira Suleymanova has appealed to the European Court for Human Rights over the issue of Dilgam Asgarov and Shahbaz Guliyev – two civilians who were taken hostage in July of last year by Armenian servicemen in Kalbajar while on their way to the district to visit the graves of their parents.
The Ombudsperson’s Office told that Elmira Suleymanova noted in her official appeal to Dean Spielman, President of the European Court for Human Rights, that the trial of the hostages at a illegitimate court of the illegal Nagorno-Karabakh Republic, which is not recognized by any country, is baseless and contrary to international law.
The appeal also says the hostages had gone to their native lands with a pure intention – to visit commemorate their parents, noting that these persons did not commit any crimes, but were detained under non-satisfactory conditions, mistreated during the period of hostage, not provided with attorneys, and did not have access to daily information and regular medical care. The appeal mentions that all these facts run contrary to international human rights, and even the norms and principles of humanitarian law.
These are also flagrant violations of article #3 (prohibition of torture), article #5 (right to liberty and security) and article #6 (right to a fair trial) of the European Convention on Human Rights.
Ombudsperson asked the European Court of Human Rights to fairly consider the case of Asgarov and Guliyev, take the acceleration of this process into account, pass decisions for their release and handover to Azerbaijan.
