Azerbaijan to ban import and trading of genetically modified crops
Those violating it can face 7-year imprisonment
Azerbaijan will ban import and trading of genetically modified crops and determine criminal responsibility in this regard.

Annexation of new articles to the Criminal and Administrative Offences Codes in this regard have been discussed at the meeting of Agrarian Policy Committee of the Parliament and recommended to the plenary meeting.

The Committee Chairman Eldar Ibrahimov informed about the projects and article #200.2 annexed to the Criminal Code (illegal circulation of genetically modified crops, or agricultural plant materials generated by modern biotech and genetic engineering or food products produced using genetic materials of genetically modified crops).

According to the first part of this article, those who deliberately import and sell a considerable amount of genetically modified crops, or agricultural plant materials generated by modern biotech and genetic engineering or food products produced using genetic materials of genetically modified crops which were not considered for scientific study, test and fairs will be fined in amount of AZN 3,000-5,000 or sentenced to up to 2-year imprisonment.

Under the second part of the article, those who produce genetically modified crops, or agricultural plant materials generated by modern biotech and genetic engineering or food products produced using genetic materials of genetically modified crops which were not considered for scientific study, test and fairs will be fined in amount of AZN 4,000-6,000 or sentenced to 3-year imprisonment.

According to the third part of the article, those who commit the abovementioned acts in the large amount will be fined AZN 7,000-9,000 or sentenced to up to 5-year imprisonment.

The fourth part of the article envisages 3-7-year imprisonment for those who commit these acts repeatedly.

The Code of Administrative Offences also includes same context. According to article #228 annexed to the Code, those, who deliberately import and sell a little amount of the genetically modified crops, or agricultural plant materials generated by modern biotech and genetic engineering or food products produced using genetic materials of genetically modified crops which were not considered for scientific study, test and fairs, will be fined in the amount of 80%-100% of worth of these crops and these crops will be confiscated. The little amount means worth up to AZN 1,000.

After discussions, the projects have been recommended to the plenary meeting.
