Azerbaijan`s judicial system has rich history. Started at the time of the Azerbaijan Democratic Republic, this history has reflected our people`s struggle for independence, its glorious past.
The Statute of the Azerbaijan Court Chamber envisaging establishment of a court system based on democratic principles and the Statute of the Ministry of Justice were approved (November 14 and 22, 1918 respectively), as well as a number of resolutions and laws in the spheres of justice and court administration were passed at that time.
The repeated changes in legal policy and abolishment and re-establishment of judicial bodies in line with conjunctural interests taken place during the soviet power, impeded formation of a stable system of justice.
Only after our nationwide leader Heydar Aliyev came to power, beginning 1970s, the judicial bodies entered the stage of sustainable development.
In the first years of Azerbaijan`s independence, as a result of political and economic recession caused by Armenian aggression against Azerbaijan and power contest, threat of civil war, mass violations of human rights and crisis of governance and law, our statehood was on the verge of downfall.
Thanks to decisiveness and political will of the nationwide leader Heydar Aliyev, who, at people`s urgent request, returned to political power in such a difficult situation, the country embarked on the path of socio-political stability, building a democratic state and implementing judicial reforms.
As a result, the country created a legislative basis meeting international standards, instituted a new judicial system based on democratic principles, conferred wider powers to judicial bodies and through transparent procedures formed a professional corps of judges and justice employees.
Highly appreciating the role of judicial bodies in ensuring the rule of law, in formation and implementation of the common state policy in the field of justice and development of legal system in general, nationwide leader Heydar Aliyev declared November 22 as professional holiday of justice employees.
Azerbaijan President`s decrees of 19 January and 17 August 2006 determined a new stage of development of justice and judicial bodies and created conditions for improving judicial system in line with requirements of the present and expanding the legal infrastructure in the regions of our country.
The main objectives of development of justice and judicial bodies during this stage of reforms are to meet the population`s demand in legal institutions and legal assistance, form a new generation of judges and jurists, raise the confidence in courts and their independence and facilitate application to courts and justice bodies.
Improvement of the legal system was also aimed at bringing in line with modern requirements the notarial and other legal services offered to the population, legal and individual person registration, forensic examination and work of penal institutions and bailiffs.
Presently, judicial and justice bodies have such tasks as guaranteeing the law, raising the effectiveness of justice even more, lawmaking and legal education, protecting human rights and humanizing the policy of punishment execution, applying new information technologies, forming human resources composed of well-trained jurists.
I am confident that judicial and justice bodies will continue their efforts aimed at building the legal state, and worthily fulfill outstanding tasks.
